Full Text Of Contempt Of Court Case Filed Against Former CJ Sarath N Silva

A contempt of case has been filed in the Supreme Court against former Chief Justice Sarath N Silva.

Three professors, Chandraguptha Thenuwara, Cyril Hewawaduge and Prishantha Gunawardena have filed the case.

The petitioners claims that the remarks made by former Chief Justice Sarath N Silva during a protest rally in Maradana were in contempt of court.

    if the courts are harassing ranjan ramanayake,why should this bugger be allowed to run amok just because he was a former CJ.Film actors and former CJ’s all should come under the same law.

    PS.How come another former CJ who went to courts and said that prageeth ekneligoda is living is france has got away scot free for contempt of court while ranjan ramanayake is harassed by courts.

      It is improper for a retired CJ to involve himself politically to advice or engage actively in party politics. This itself will be an offense for a Law suit. This man former CJ Sarath N Silva has a deadly past of underworld connections. Remember Justice Sarath Ambeypitiya, he and another Judge was collecting material of what this man was up to. Then when Sarath N Silva came to know Sarath Ambeypitiya’s friend left the country and asked Sarath Ambeypitiya also to leave the country. Sarath Ambeypitiya did not heed his friend’s advice thinking he was safe with a Police guard. This man Sarath N Silva then had organised the killing of Justice Sarath Ambeypitiya using some underworld thugs and implicated Potta Naufer in the crime. Sarath N Silva also had another man an underworld character at the Judicial Service Commission Office in Colombo. This man figured prominently in two killings where the assailants had made contact with him after killing the targets. One was Godakumbura the Proprietor of the Cafeteria at the Royal Botanical Garden Kandy, where the assassin had been hired by his estranged wife. The Police caught the assassin while he was trying to leave the Gardens. The mobile phone in his possession and the weapon revealed the connections to this caretaker at the Judicial Service Commission Office. Thereafter other than the initial release of news nothing was reported on the matter afterwards. The other was an accused drug peddler who was killed within the Court premises at the Negambo Courts. Here again the assassin was caught by the Police,. Like before he too had taken a call to the Caretaker at the Judicial Service Commission head Office soon after accomplishing the job. Again the CID Police drew a blank. I believe both cases were hushed up by Sarath N Silva’s intervention.

    Observing this man’s behaviour and utterances over the years has convinced me beyond any doubt that he is a sociopath. How he became chief justice will always remain one of life’s great mysteries to me.

      How Sarath Silva became CJ?
      How have your forgotten the fact that it was former President Chandrika Kumaratunge aka Bandaranaike in her blind infatuation appointed this man as CJ over the rightful judge Mark Fernando.
      Read Victor Ivan’s book for a better understanding about his antics. Sorry the title of it just isn’t in mind now.

    I heard this will be a Closed Court hearing as the Courts will not like what the former CJ has to say. I heard the other former CJ also says that I she did something wrong that was why she had to go. She accepts it.

    We are great full to 3 professors for bringing this matter to the judiciary. This man has been playing with the minds of people uttering lies after lies using his former position. Thanks for the efforts of Victor Ivan who fought against this man to achieve justice relentlessly , Hope and pray that he will meet his waterloo this time.

    Is the most disgraceful CJ to be appointed, He had no moral values, or principles. Everyone wants him indicted for contempt of SC court by his utterances at public meetings. People know what he did in the case of Helping Hambantota , and subsequently admitting and regretting, he willfully made the wrong judgement and did not send former President to Jail. So he needs to be punished

    We always thought that top judiciary will never do any wrong. Stories did circulate about former Chief Justice Sarath N Silva but were never investigated. The former CJ did indulge in politics.
    Thank you Prof Chandraguptha Thenuwara, Prof Cyril Hewawaduge and Prof Prishantha Gunawardena for filing a contempt of court case in the Supreme Court against the former Chief Justice Sarath N Silva for remarks he made during a protest rally in Maradana.
    The outcome will put our minds to rest.

    Sri Lankan judges are like the Sri Lankan politicians, same attitude, same culture and same gene pool.

    Even in this very important parliament dissolution case only one judge wrote the judgement and other judges just wrote -“I agree”

    Anyone can do that. I am told that in other countries each judge writes his own judgement so that all can see his reasoning and also how well he understood the case.They earn their salary and also win our respect.

    Our judges have bodyguards and also enjoy many benefits. Same as our politicians. Remember the disgraceful political judges-Sarath Silva, Mohan Peiris, Shirani Bandarnayake ?This country simply has no talent and also no integrity.

      You refer, I presume, to the recent judgement by the seven member bench, Kolla.

      My understanding is different, although, obviously, a layman cannot know much. I have read other judgements. I think that there’d be a good deal of discussion, and then one judge (usually the most senior), writes it out (acts as scribe); the others sign as here, saying that they agree. If there had been seven different judgements, it could also cause complications when moved elsewhere. In this case, of course, there can be no appeal to a higher court – since there is no higher court.

      However, haven’t you realised that Justice Sisira de Abrew has not signed here. We have yet to see his slightly different arguments, although he is said to have come to the same conclusions. What you should have done is to ask to see his “dissenting” judgement.

    It is very encouraging to observe that academics of standing and civil society activists are taking serious interest in exposing the frauds of people such as Sarath Silva who masquerade as learned men and mislead the society. Even GLP should be exposed.

      Srilanka become a disgraced nation now because the justice system lost its creadibility because of few individuals who acted against the justice, nation and people in order to get few benefits to them or their close associates. They sold this country. We are now in 21st centuray and we have lot of information available to decide in making decisions. Unfortunately, we still unable to come out of the fear that was built up by those opportunistic racist, fundamentalist idiologists. Political and Religious leaders should unite the people, not to divide/ or hate the people. Power of individuals should be limited whether it is President or Prime Minister or Chief Justice or Military Commander. All should be equal under the law and all should be accountable for their actions.

      Wheels of justice may turn really slow, but will grind exceedingly fine. Reading through the Court submission throws light on the extent of abuse, misuse of authority, and taking action to only satisfy his own personal whims and fancies, without any limits. He has brought nothing but total disgrace to the highest post in the judiciary. Still, this list of abuse is incomplete, going by what we know of, like his judgment and approval on party cross-overs, personal misdemeanors like getting caught in the act with a junior Attorney, on a lonely stretch of road. I am sure there will be plenty more allegations to surface as time goes by. In addition to all of his own weaknesses, he used to appear on a particular TV channel every evening (he even has a notoriously silly laugh), lecturing to others on how to lead a saintly life.

    Can’t wait to see the day when this joker is dragged before the Courts. Happy to chip in to any funds raised to bring corrupt politicians and senior bureaucrats, who abused their positions. Good on the three academics, who brought this case. All the best with your action.

    Among the many innocent learned men Sarath Silva harmed was the pleasant
    and decent Elmore Perera – former Survey General, Advocate and also, I understand, qualified Accountant. He takes great interest in the general good of civil society
    heading several causes. I believe he was also a former President of the OPA. Sarath S had his name removed from the rolls merely for continuing to speak in Court. Elmore is a religious and mild gentleman. He didn’t fight back. He now should seek the restoration of his legal status.

    If at all there is a day, I will like to see this low life dragged to courts and put behind bars with the hard core criminals. Not just in politics I know personally this SOB has caused immense pain and trauma to the public by sitting on the bench. He is corrupt and done a lot of favors in non political cases too.

    There is a procedure to be followed in cases of Contempt of Court,which was not followed by Sarath.N.Silva.
    The time has come to teach this bugger a taste of his own medicine!

    Recheck qualifications of all these three professors. No Ph.D. from at least from world top 100 Universities. and any single publication in high impact journals. Then how they become professors. Thanks to Ranil’s government. This is the real situation in Sri Lankan public sector Universiti8es.

    The damage caused to the country by his man is enormous. He has no integrity and deserves to be punished. I thank the professionals for the efforts in compiling the detailed petitions to drag this criminal before the courts. Proceed with diligence and don’t give into any threats, you are doing a great service to the nation.
